- 15-20 min arrival
- IICRC certified

Quick answerWhen a tenant dies, call 911 and wait for the medical examiner’s release. Wisconsin law (section 704.165) sets when the lease ends, and separate rules cover property left behind. Cleanup is usually covered by the landlord’s property insurance. VerdaCrest documents everything for you. Reviewed by Devonte, who leads our Racine team · Updated November 2026.

The law
Belongings and the lease
Wisconsin statute 704.165 covers when the lease ends after a tenant dies, and separate rules cover property left behind. Read them, or talk to your attorney, before disposing of anything.
We protect belongings during cleanup and follow your instructions.
Cleanup
Getting the unit back
We give you a written scope, clean, dispose compliantly and rebuild if needed, with photos and an itemized invoice for your insurer.
The lease
When the tenancy ends
Under Wisconsin statute 704.165, when a tenant dies, the tenancy generally ends 60 days after the landlord learns of the death, or at the end of the lease term, whichever comes first. The estate isn’t liable for rent after that, and any rent owed is subject to your duty to mitigate. Another adult tenant on the lease stays responsible under the rental agreement.
The statute also says a landlord may not contact the tenant’s family to collect rent the family doesn’t owe. Read the current statute or talk to your attorney before acting.
Belongings
The tenant's property
Wisconsin law has separate rules about personal property a tenant leaves behind. Don’t dispose of a deceased tenant’s belongings until you’ve checked those rules and, ideally, talked with the family or the estate.
During cleanup, we set belongings aside, protect them from contamination where we can and document what had to be removed because it was contaminated. That record protects you if questions come up later.
The building
Neighbors and shared spaces
In two-flats, duplexes and apartment buildings, a death in one unit can affect others. Check the unit below for stains or odor and the shared hallways and ventilation. We do that as part of our evaluation.
Let other tenants know a cleanup is happening without sharing private details. We work quietly, control odor in common areas first and keep our time in the building as short as we can.
